Terms and Conditions

 It is up to the Customer to check the quantity and condition of the goods upon delivery.

5. Time of delivery
We try our very best to meet all delivery times. However, there may be delays – e.g. postal/carrier delays, logistics, or bad weather. We will keep you updated as much as we can, and you should be able to track your order.

The estimated delivery time is 2 to 5 working days for mainland Portugal; 7 to 8 working days for Madeira Island; 8 to 9 working days for Porto Santo Island; 8 to 11 working days for São Miguel Island; 9 to 14 working days for Santa Maria, Terceira, Faial, Pico, Graciosa and São Jorge Islands and 10 to 17 working days for Corvo and Flores Islands.

There are products, which due to limited stocks, may have a longer delivery and this information is available on the product page.

In case the same order includes items subject to different delivery periods, the delivery period for the whole order will be that of the item with the longest delivery period.

In case we run out of stock, the customer will be contacted by email about the new expected delivery date and he/she will decide whether to maintain or cancel the order.

The foreseeable time for delivery of goods is set in the information associated with each item.

6. Payment methods
The Customer can purchase using the ATM reference, card (Visa; Visa Electron; V-Pay; MasterCard; Maestro) or MBWAY.

In case of ATM payment, the reference will be available for a 3 (three) days period. If payment is not made within this period, the order will be automatically cancelled.

In the case of credit card payments, all transactions will be stored by the service provider for possible consultation by IFTHENPAY.

7. Cancelling the order
The customer may cancel the order, provided that it has not yet been processed by Pó de Barro. The cancellation of the order may be formalized by an email sent to the address online@podebarro.pt or using the form available on the website for that purpose.

The Customer must mention the order number and his tax identification number, under penalty of ineffectiveness of the cancellation.

8. Refusal of the order
Pó de Barro reserves the right to refuse the order, in which case it will inform the Customer, given the following cases:

a) Out of stock;

b) Unavailability of the item;

c) If Pó de Barro considers that there has been misconduct by the buyer or inaccuracies in the personal data recorded.

9. Returns
The customer may return the product within 14 days of receiving it. Within that same period the customer may file a complaint about any defects or inadequacy of the product compared to what was ordered, being the responsibility of Pó de Barro.

The return should be made using the form available on the website for this purpose or by email sent to the address online@podebarro.pt, always mentioning the order number. In the complaint, the Customer shall expressly indicate the reasons for complaining.

The support team of the www.podebarro.pt website will coordinate with the Customer how to proceed with the return of the goods. For more information on this matter click here.

The return will only be accepted after checking the state of the items and their packaging. In situations where reasons for return are the responsibility of Pó de Barro (e.g.possible defects, faults, or misrepresentations), Pó de Barro will assume the costs of the shipment. In situations where the reasons for the return are not the responsibility of Pó de Barro, the shipment costs are the customers responsibility.

Consequently, Pó de Barro reserves the right to not accept returns of products without prior notice, as mentioned above, and which do not meet the same conditions of conformity as they did on the date of their delivery to the Buyer (namely products that have undergone any use, transformation, damage and/or are missing the original packaging/accessories/extras).

10. Limitation of the liability
We make every effort to ensure that the information presented is free of typographical errors and whenever they occur, we proceed with their correction as soon as possible. In case the information provided does not match the characteristics of the product, the Customer has the right to return it in accordance with paragraph 9.

The photographs presented on the site are merely illustrative. We recommend that you consult the product characteristics for detailed information.

Despite the efforts of Pó de Barro, some products may have an incorrect price, therefore we also check the prices when processing orders. If the price of the product is less than the advertised price, we will refund the difference. If the price is higher, we will inform the customer by email and await his decision as to whether or not he accepts the new price or if he wishes to cancel the order.

11. Registration and protection of personal data
When registering to use this website, we will ask the Customer to create a password. The Customer should keep it strictly confidential, not revealing nor sharing it with third parties. The Customer is entirely and exclusively responsible for the use of his password and any orders placed by using it, even without his knowledge.

In the case of registered Customers, we will collect the information required to carry out the whole sales transaction online and for future contacts that may be necessary so as to ensure the best customer service.

The Customer assures that the personal data provided are true and accurate and undertakes to notify any changes. Any loss or damage caused to the online store or a third party resulting from incorrect inaccurate or incomplete information on the registration forms will be the sole responsibility of the Customer.

The services provided by Pó de Barro will always honour the provisions of the Personal Data Protection Law – Law no. 58/2019 of August the 8th, therefore, the sole purpose of Pó de Barro regarding the Customer’s personal data is the customer’s account management, billing, communication with customers and statistical analysis, assuming the commitment to privacy and security in the processing of personal data of each customer.

The customer authorizes through the subscription of the Newsletter of Pó de Barro to send information on products and services that may be of interest, using their personal data for direct marketing. 13. Intellectual and industrial property

All texts and images reproduced or represented in the www.podebarro.pt site are the sole property of Pó de Barro and are, as such, strictly reserved for Pó de Barro and protected under copyright and intellectual property rights regarding third parties.

Any reproduction or representation, whether total or partial, of the www.podebarro.pt site or of all or part of the elements included in it is strictly forbidden.

Trade names, trademarks or distinctive symbols reproduced in the www.podebarro.pt site are protected under the laws applicable to industrial property. The reproduction or representation of all or part of any distinctive symbol is strictly forbidden.

14. Applicable law and jurisdiction
These Terms and Conditions for online shopping in the www.podebarro.com site are governed by Portuguese legislation.
The parties agree that any dispute arising from the interpretation and/or application of these Terms and Conditions, whose amicable settlement is not reached, will be submitted exclusively to the jurisdiction of the courts of the headquarters of the Pó de Barro, with express waiver to any other.
By using the online store, the Customer accepts and agrees with these Terms and Conditions and the Privacy Policy and Personal Data Protection.
